I'm not getting fps lock if I set to 250 or 333

It ranges from 190-333 and is going up on down

How to fix?

Go to your settings.xml
Search this line:
PHP Code:
  <NHARDWARETNL>false</NHARDWARETNL> 
Replace it in this line:
PHP Code:
  <NHARDWARETNL>true</NHARDWARETNL> 
Save the edit to your desktop,delete the old settings.xml on your UGG folder and replace with the new settings.xml.
